April 8, 2008

Present: Bob Gibb, Joanne Peterson, Joe Yaver, Rudy Schaad, Barbara Zielstra, Frank Eventoff, Ken Wilcox and Vivian Bartlett

Called to order at 7:29 PM by Bob Gibb but some discussion preceded the call to order.

Minutes:  The minutes from the March 25, 2008 meeting were approved as written.

Financial:  Treasurer Joanne Peterson reported on the balances in both accounts. (Statements attached in permanent record.)


A bill for legal services was received.  Motion to pay was approved.

Lawsuit by “North Sound Conservancy”:  Bob read the letter he sent to our attorney regarding grievances against CMPD by the Skagit BRB for his petition to court.


A discussion of the legal documents filed followed.  The documents are an appeal of the Skagit Boundary Review Board decision, a Writ of Mandamus and a request for a restraining order.


Discussed Barbara’s work on the PR Committee’s statement of purpose.  Amendments were made to the declaration.  Motion to accept amendments approved.  Amended copy will be sent to those present for final approval with subsequent posting to website.

Updating the website was discussed.


Bob read the letter from Pat Atkinson regarding Whatcom County and Whatcom County BRB’s decision to not pay for the SEPA and also their request for a blank check from CMPD for the cost.  Discussion regarding researching the cost of a SEPA followed.

Bob contacted the Planning Department to inquire about the cost for processing the SEPA and is waiting for a reply.


Correction to Minutes from 3/25/08:
  Clarification that Pam Went resigned from her position on the CMPD AC and as secretary.

Called to order at 7:05 PM by Bob Gibb. Introductions.

 

Minutes: The minutes from the February 26, 2008 meeting were approved as written.

 

Financial: Treasurer Joanne Peterson reported on the balances in both accounts. (Statements attached in permanent record.) Bob noted two accounts payable for legal and for supplies. Both expenditures were approved by members present.

 

OLD BUSINESS

 

Bob read his response to the Chuckanut Community Fire Fighters Association and members approved it.

 

Skagit Boundary Review: Skagit denied the CMPD application. Bob has requested copies of various documents for reference. Ken was applauded for his impressive skill with the power point and presentation. Discussion about many related issues including that the BRB decision does not appear to be supported by any of the necessary criteria.

 

There was a motion that the CMPD AC reaffirm its previously stated position of support for the protection of Blanchard Mountain. This motion was passed.

 

Ken suggested going on the offence by addressing each of the misinformed and misleading ideas circulated by NSC and others with the facts.

 

Whatcom Boundary Review Board Meeting: The meeting became more of a Hearing where time requirements were not properly observed etc. Bob has requested copies of documents from this as well for reference.

 

Bob addressed the serious harassment issues related to meeting attendees as well as possibly related personal property destruction.

 

The Writ of Mandamus is being prepared. There was discussion of various options available for the CMPD AC.

 

NEW BUSINESS

 

·        Lake Samish would still like a presentation

 

·        WWU Retirement Association would like a presentation

 

·        Fund raising for legal costs.

 

Frank discussed the perceived “lack of a plan” and the need for a response for this. Although it’s been repeatedly explained that, by law, it is only the elected commissioners who will ultimately have this responsibility, it may be possible to draft something helpful based upon the numerous existing studies that have guided our thinking and to which we refer.

 

Kris, Rudy, Barbara and Joanne (and any interested others) will meet regarding developing a promotional campaign for the CMPD. They will report back at the next meeting.

Minutes: Minutes from the February 12, 2008 meeting were approved as written.

 

Financial: Treasurer Joanne Peterson reported on the balances in both accounts. (Statements attached in permanent record.)

 

Boundary Review: Two meetings are scheduled for March 6, 2008. The Skagit hearing will be at 1:30 PM at the Skagit County Commissioners Hearing Room, and the Whatcom meeting will be at 7 PM in Sehome High School’s cafeteria.  In light of these, and the ongoing delay in action, we have been advised to consider granting a second extension period. There was considerable discussion regarding tactics, the Boundary Review Boards themselves, and varying kinds of extensions. As neither board has been able to accomplish their obligations in either their initial timeframe (120 days) or the first extension we granted (180 days), Bob was asked to negotiate and obtain the minimum extension necessary.  Evidently the issue continues to be the SEPA and whether a lead agency will review and sign off on it, and if so, which agency should do this.

 

Visitors Bureau: Bob reported that the meeting with their Executive Committee went fine and that we were able to provide good information and documentation. There was general agreement that open space is a significant draw for the increasing tourism in our area and that it must be preserved.

 

Correspondence: Bob read a letter from the Skagit Agricultural Advisory Board to the BRB requesting that agricultural land not be included in the proposed CMPD boundaries.  From the nature of the correspondence it was very clear that the group was not familiar with the actual CMPD proposal. Bob shared a response he had drafted and there was consensus that the letter was excellent and should be sent on behalf of the Advisory Committee to the SAAB with a cover to the BRB.

 

The Chuckanut Community and Fire Fighters Association President wrote to ensure we understand, for the record, that they have not made a decision about whether to support the CMPD proposal. It was agreed that none of our literature had suggested they had, nor have our presentations. However, it was noted that we do share how very much the committee appreciates the ongoing use of the fire hall for the public committee meetings. A letter requesting the identification of the claimant will be sent.

 

Bob reported that he had sent both BRBs a statement regarding the typo in the petition.

Boundary Review Board: Bob reported that the agenda for the February 21st BRB meeting has not been announced but that it will address the RFP and SEPA status.  Ken and Frank said that we should ask the BRB when it would be appropriate for us to put comments that we would like to make into the record.  Frank will inquire about the status of the Memorandum of Understanding between the two Boundary Review Boards.

 

Lawsuit by “North Sound Conservancy”: Bob reported that our attorney has not yet filed intervention.

 

General Informational Updates/NEW BUSINESS

 

The CMPD has been invited to participate in a panel with NSC at Lake Samish on April 17th.

 

Ken suggested that we organize a series of events to educate people about the Chuckanuts.

 

Ruth Ann asked for clarification of when the commissioners are elected.  (They are on the ballot with the park district and are elected only if it passes.)

 

There was discussion of Oyster Creek (nearby logging activity), Blanchard Mountain and Chuckanut Ridge.

Present:  Bob Gibb, Pam Went, Barbara Zielstra, Rudy Schaad, Frank Eventoff, Ken Wilcox, Kris Wilcox, Vivian Bartlett, Ruth Ann Mayer

 

Minutes: Minutes from January 8, 2008 were approved as written with the addition of the $500 price limit for the map that Ken will be ordering.

 

Financial:  In the absence of Treasurer Joanne Peterson, Pam provided the balances in the two accounts. (Statements attached in permanent record.)

 

Boundary Review Board: The Hearing initially set for January 24th has been changed to February 21st at 7 PM.

 

Lawsuit: The judge in the case has requested records. The motion on behalf of the CMPD AC to intervene has been filed. The Chuckanut Conservancy intends to file for an intervention as well. There was discussion of other sympathetic groups that may also wish to have standing in the case.

 

Blanchard: Bob circulated a list of clear-cut logging permits filed within the past two years. There was discussion regarding the implications of such logging for the watersheds.

 

Chuckanut Ridge/”Fairhaven Highlands”: The scoping meeting was very well attended and the presentations, including a well thought out one by the Coalition of Southside Neighborhoods, were excellent.

 

Outreach: Bob has received a call from Joan Ellsworth of the Lake Samish neighborhood inviting the CMPD AC to participate in a moderated forum with members from the “North Sound Conservancy” on April 17th. Our attorney has indicated there would be no reason not to do so, and the discussion indicated an interest in attending.

 

Ballot Considerations: Bob reminded the group that if and when we file to have the proposed park district on the ballot, candidates for commissioners must file at the same time. Thus, it is important to begin to identify prospective candidates. Potential election dates and filing deadlines for the remainder of 2008 were presented. Pam agreed to find out when the Bellingham Public School District and the Bellingham Library Board were planning to be on the ballot in the coming months.

Call to order at 7:05 PM by Bob Gibb followed by introductions

 

Minutes: Minutes from December 11, 2007 were approved as written.

 

Financial: Treasurer Joanne Peterson reported on the balances in both accounts. (Statements attached in permanent record.) She noted Rudy’s generous donation the previous month, and during the meeting an additional donation was received.

 

Boundary Review Board: Bob reported that there has been no new information as they are likely in a holding pattern due to the lawsuit.

 

Lawsuit by “North Sound Conservancy”: Bob gave an overview of the situation. After discussion, there was a motion that “this meeting recommends that we intervene” contingent upon confirmation from our attorney regarding liability. After consultation with our attorney, a final decision will be made by the executive committee of the four officers. This was passed. Bob noted that there would be associated attorney fees. Bob will contact our attorney Wednesday morning and then report to the officers. It was noted that other local environmental groups are considering filing interventions as well.

 

General Informational Updates/NEW BUSINESS

 

Blanchard Mountain’s New Year’s Day hikers spotted a Peregrine Falcon!

Regarding the lawsuit, there will be a first hearing from the judge in April in Seattle. The Chuckanut Conservancy has 501 c. 3. status.

 

The Coalition of Southside Neighborhoods held an informational meeting on January 7th to determine if there was consensus for a unified response to the request for scoping for the EIS on the Chuckanut Ridge property. There was broad support for this and a committee will compose a letter on behalf of the five neighborhoods.

 

Bob reported on several requests for rezoning in the Samish Neighborhood in Bellingham that were noted in the local paper. Bob also noted the recent letter to the editor from Lynn Carpenter and said that he had been informed that it amounted to an endorsement for the CMPD.

 

There was discussion of the new Washington State initiative to protect urban trees followed by thoughts about the creation of a tree protection ordinance for the City of Bellingham.

 

Joanne reported that King Mountain neighbors are very concerned about potential annexation by the City. Developers are petitioning for this on January 10th at a Boundary Review Board Hearing.

 

There was discussion about the number of new logging permits being requested and granted in the Chuckanut area without any Environmental Impact Statement.

 

Ken spoke about the opportunity to have a large detailed map professionally created for CMPD promotional purposes. There was agreement to fund this acquisition up to $500 and Ken will pursue this for the group.
